Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Vakil Ventures LLC ("we," "our," or "us") governing your access to and use of the TailorTail mobile application ("App").
By downloading, installing, or using TailorTail, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or by other means. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.
Description of Service
TailorTail is an AI-powered mobile application that transforms photos of pets into stylized artwork. The service uses artificial intelligence (Google Gemini) to generate unique artistic interpretations of user-uploaded pet photos based on selected styles.
The App offers both free and subscription-based tiers with varying features and usage limits as described in these Terms.
User Accounts
TailorTail can be used without creating an account. Certain features, such as profile customization and cloud sync across devices, require signing in with Apple Sign-In or Google Sign-In.
If you create an account, you are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.
User Content
Your Content
You retain ownership of the photos you upload to TailorTail ("User Content"). By uploading photos, you grant us a limited, non-exclusive license to:
- Process your photos through our AI service to generate artwork
- Store your photos temporarily during processing
- Store generated artwork in your account (if signed in)
Content Requirements
You represent and warrant that your User Content:
- Is your own original content or you have the right to upload it
- Does not infringe any third party's intellectual property rights
- Does not contain illegal, harmful, or objectionable material
- Contains only appropriate pet photos as intended by the service
Prohibited Content
You may not upload content that:
- Contains nudity, violence, or sexually explicit material
- Depicts animal abuse or cruelty
- Contains hate speech, harassment, or discriminatory content
- Violates any applicable laws or regulations
- Infringes on others' privacy or intellectual property rights
- Contains malware or harmful code
We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts of repeat offenders.
Intellectual Property
Our Intellectual Property
The App, including its design, features, code, and content (excluding User Content), is owned by Vakil Ventures LLC and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.
Generated Artwork
Artwork generated through TailorTail is created using AI technology. While you have the right to use, share, and enjoy the artwork generated from your photos for personal, non-commercial purposes, the underlying AI models, styles, and generation technology remain our property.
Pro subscribers may use generated artwork for commercial purposes, subject to these Terms.
Style Library
The style library, including style names, descriptions, and reference materials, is our proprietary content and may not be reproduced or used outside the App.
Subscriptions & Payments
TailorTail Pro
TailorTail Pro is our premium subscription offering enhanced features including:
- Unlimited AI generations
- No watermarks on generated artwork
- No advertisements
- Access to all styles including premium styles
Subscription Plans
We offer the following subscription options:
- Weekly: Billed weekly with automatic renewal
- Yearly: Billed annually with automatic renewal (best value)
Billing & Renewal
Subscriptions are processed through the Apple App Store or Google Play Store. Payment will be charged to your Apple ID or Google account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation
You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation will take effect at the end of the current billing period, and you will retain access to Pro features until then. No refunds are provided for partial subscription periods.
Price Changes
We reserve the right to change subscription prices. Price changes will not affect current subscription periods and will be communicated to you in advance.
Free Tier Limitations
The free tier of TailorTail includes:
- 3 generations per day: Usage resets daily at midnight (UTC)
- Watermarked output: Generated artwork includes a TailorTail watermark
- Advertisements: Free users may see ads; watching a rewarded ad can remove the watermark from a single image
We reserve the right to modify free tier limits at any time.
Prohibited Uses
You agree not to use TailorTail to:
- Violate any applicable laws or regulations
- Infringe on others' intellectual property or privacy rights
- Transmit viruses, malware, or other harmful code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the service or servers
- Use automated systems, bots, or scripts to access the service
- Circumvent usage limits, subscriptions, or security measures
- Reverse engineer, decompile, or disassemble the App
- Use the service for any commercial purpose without authorization
- Create derivative works based on the App
- Resell or redistribute the service or generated content
Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will meet your specific requirements
- The App will be uninterrupted, timely, secure, or error-free
- The results obtained from the App will be accurate or reliable
- The quality of generated artwork will meet your expectations
AI-generated content may produce unexpected or imperfect results. The quality and style of generated artwork may vary based on the input photo and selected style.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VAKIL VENTURES LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the App
- Any unauthorized access to or use of our servers or any personal information stored therein
- Any interruption or cessation of transmission to or from the App
- Any bugs, viruses, or the like that may be transmitted through the App
- Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination:
- Your right to use the App will immediately cease
- We may delete your account and associated data
- Active subscriptions will not be refunded for the remaining period
You may terminate your account at any time by deleting the App and, if applicable, canceling your subscription through the App Store or Google Play Store.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
